Welcome to PromptBuilder. By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). Please read them carefully before using the App.

1. Acceptance of Terms

By accessing or using PromptBuilder, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

PromptBuilder is an AI-powered image generation application that allows users to create images using text prompts and various creative tools. The App offers both free and premium subscription tiers with different features and usage limits.

3. Eligibility

You must be at least 17 years old to use PromptBuilder. By using the App, you represent and warrant that you meet this age requirement.

4. Account Registration

Some features may require account creation. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Subscription Terms

Auto-Renewable Subscriptions

PromptBuilder offers the following auto-renewable subscription options:

Monthly Pro Subscription: $7.99/month - Provides 70 image generations per month, ad-free experience, and premium features.
Yearly Pro Subscription: $69.99/year - Provides 100 image generations per month, ad-free experience, and premium features.

5.1 Billing

Payment will be charged to your Apple ID account at confirmation of purchase.
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

5.2 Free Trial

If offered, any unused portion of a free trial period will be forfeited when you purchase a subscription.

5.3 Price Changes

Subscription prices may change. We will notify you in advance of any price changes, and you will have the opportunity to cancel before the new price takes effect.

6. User Content and Conduct

6.1 Your Content

You retain ownership of any content you create using PromptBuilder. However, you grant us a license to use, store, and process your content as necessary to provide the service.

6.2 Prohibited Content

You agree not to use PromptBuilder to create, upload, or share content that:

Is illegal, harmful, threatening, abusive, or harassing
Contains nudity, sexually explicit material, or pornography
Depicts violence or promotes violence against any person or group
Infringes on intellectual property rights of others
Contains malware or harmful code
Impersonates any person or entity
Violates any applicable laws or regulations

6.3 Content Moderation

We reserve the right to review, remove, or disable access to any content that violates these Terms without prior notice.

7. Intellectual Property

7.1 Our Rights

PromptBuilder, including its design, features, and content (excluding user-generated content), is owned by us and protected by intellectual property laws.

7.2 AI-Generated Content

Images generated using PromptBuilder are created using Google's Gemini AI. You may use generated images for personal and commercial purposes, subject to:

8. Third-Party Services

PromptBuilder integrates with third-party services including:

Google Gemini API: For AI image generation
RevenueCat: For subscription management
Google AdMob: For advertising (free tier only)

Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the App and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
